1. Acceptance of Terms
Welcome to Jet Skills (the "Platform"), operated by 【legal entity name — TBD】 ("we", "us"). These Tutor Terms of Service (the "Terms") govern your participation as a tutor on the Platform. By submitting a tutor application or providing lessons through the Platform, you agree to be bound by these Terms.
2. Independent Contractor Relationship
You provide tutoring services as an independent contractor. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between you and the Platform. You are solely responsible for your own equipment, working environment, insurance, and — subject to Section 7 — taxes.
3. Application and Approval
Tutoring on the Platform is by application and approval. You warrant that all information in your application and profile (identity, credentials, languages, videos) is accurate and kept up to date. We may suspend or remove profiles containing false or misleading information.
4. Products, Pricing and Currency
You set your own lesson prices in US dollars through the Platform's pricing tools. Learners are charged in New Taiwan dollars at a converted price that includes the Platform's service margin. We may adjust the displayed learner-facing price without changing your USD earnings basis.
5. Platform Fee
The Platform charges a service fee of ten percent (10%) of your lesson price for each completed session. Fees are deducted automatically before earnings are credited to your balance.
6. Earnings and Payouts
Earnings are credited per completed session and become withdrawable once confirmed. Earnings for a disputed session are held until the dispute is resolved, and are voided if the dispute is resolved as a tutor no-show. You may withdraw your confirmed balance on demand in USD via the supported payout providers (e.g. Stripe, Payoneer, Wise). Payout provider fees and exchange-rate spreads applied by providers are borne by you.
7. Taxes
You are responsible for reporting and paying all taxes applicable to your earnings in your jurisdiction. Where Taiwanese law requires the Platform to withhold tax or issue tax documentation for payments made to you, we will do so and provide the corresponding certificates through your dashboard.
8. Bookings, Cancellations and No-Shows
You must respond to booking requests within twenty-four (24) hours; unanswered requests expire automatically. Confirmed lessons may be rescheduled only with the learner's agreement and at least 24 hours before the proposed new time. If you cancel a confirmed lesson, the session is returned to the learner. A dispute resolved as a tutor no-show voids your earnings for that session, refunds the learner, and records a strike against your account; repeated strikes may lead to suspension or removal from the Platform.
9. Lesson Conduct
Lessons are delivered by video through the Platform's integrated meeting tools. You agree to start lessons on time, deliver the full scheduled duration, complete lesson records where required, and behave professionally toward learners at all times.
10. Non-Circumvention
For learners you first met through the Platform, you must not solicit, accept, or arrange payment for lessons outside the Platform, nor direct such learners to off-platform booking or payment channels. Violation is grounds for immediate termination and forfeiture of unconfirmed earnings.
11. Content and Intellectual Property
You retain ownership of teaching materials you create. You grant the Platform a non-exclusive, worldwide, royalty-free license to host, display, and promote your profile content (including photos and videos) for the operation and marketing of the Platform.
12. Learner Data and Confidentiality
You may use learners' personal data (names, contact records, lesson history) only as necessary to deliver lessons through the Platform, in compliance with Taiwan's Personal Data Protection Act and the Platform's Privacy Policy. You must not export, sell, or use such data for any other purpose.
13. Suspension and Termination
We may suspend or terminate your account for breach of these Terms, fraudulent conduct, repeated no-shows or strikes, or conduct harmful to learners or the Platform. You may stop offering lessons at any time; confirmed earnings remain withdrawable after termination unless forfeited under Sections 8 or 10. Sessions already purchased by learners must be honored or will be refunded to the learners.
14. Disclaimers and Limitation of Liability
The Platform is provided "as is". We do not guarantee any volume of bookings or income. To the maximum extent permitted by law, our aggregate liability to you is limited to the total platform fees we collected from your sessions in the six (6) months preceding the claim.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email or dashboard notice with an updated version number and effective date. Continued use of the Platform after the effective date constitutes acceptance.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of China (Taiwan). Any dispute shall be submitted to the Taiwan Taipei District Court as the court of first instance, unless mandatory law provides otherwise.
